Welcome to Reliant Trading CC (“Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your use of our website located at [www.relianttrading.com] (the “Site”) and any services provided by Reliant Trading CC, including but not limited to branding, visual identity development, graphic design, social media marketing, web design, web development, consulting, and related creative services (collectively, the “Services”).

By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or Services.

1. Use of the Site

  • 1.1 You must be at least 18 years old to use this Site or engage our Services.
  • 1.2 You agree to use the Site only for lawful purposes and in accordance with these Terms.
  • 1.3 We reserve the right to modify, suspend, discontinue, or restrict access to any portion f the Site or Services at any time without prior notice.
  • 1.4 Unauthorised use of this Site may give rise to a claim for damages and/or constitute a criminal offence.

2. Services

  • 2.1 Services are provided according to individual project proposals, quotations, Masters Service Agreements (“MSA”), Statements of Work (“SOW”), or service agreements issued to the Client.
  • 2.2 Project scope, timelines, deliverables, revisions, milestones, and fees will be defined in the applicable agreement.
  • 2.3 Any work requested outside the agreed scope may be treated as a Change Request and may incur additional fees and revised timelines.

3. Deposits, Payments & Billing

  • 3.1 A non-refundable deposit, typically a minimum of forty percent (40%) of the total project fee, may be required before work commences.
  • 3.2 Remaining balances may be divided into milestone payments as outlined in the applicable project agreement.
  • 3.3 Milestone payments become due upon completion of the relevant milestone phase.
  • 3.4 Final deliverables, source files, website transfers, launch deployments, or ownership rights may be withheld until all outstanding amounts have been paid in full.
  • 3.5 Late payments may result in:
    • 3.5.1 Suspension of work;
    • 3.5.2 Delayed project timelines;
    • 3.5.3 Additional administrative or interest charges where legally permissible.

4. Refund & Cancellation Policy

  • 4.1 Due to the nature of creative and digital services, deposits are non-refundable once work has commenced.
  • 4.2 Clients may cancel a project at any time by providing written notice.
  • 4.3 In the event of cancellation:
    • 4.3.1 The deposit remains non-refundable;
    • 4.3.2 All completed milestones remain payable in full;
    • 4.3.3 Any work completed but not yet invoiced will be billed proportionally based on progress completed;
    • 4.3.4 Any third-party costs already incurred on behalf of the Client remain payable.
  • 4.4 If cancellation occurs during an active project phase or milestone, Reliant Trading CC reserves the right to invoice for work completed up to the cancellation date.
  • 4.5 No refunds shall be issued for:
    • 4.5.1 Approved work;
    • 4.5.2 Completed milestone phases;
    • 4.5.3 Digital deliverables already supplied;
    • 4.5.4 Strategy or consulting services already rendered.

5. Revisions and Approvals

  • 5.1 Revision rounds are limited to the number specified in the applicable project agreement.
  • 5.2 A revision round constitutes one consolidated set of feedback from the Client and one corresponding update from Reliant Trading CC.
  • 5.3 Additional revisions, changes in direction after approval, or requests outside the agreed scope may incur additional fees.
  • 5.4 Written approval (including email approval) of a deliverable or project phase constitutes acceptance of that phase.
  • 5.5 Once a phase has been approved, substantial changes or reversals may be treated as new work and billed separately.

6. Client Responsibilities

  • 6.1 Clients agree to provide all required content, materials, access credentials, approvals, and information necessary for project completion.
  • 6.2 Clients are responsible for ensuring they have the legal rights to any content, imagery, trademarks, or materials supplied to Reliant Trading CC.
  • 6.3 Delays in providing feedback, approvals, or required materials may result in revised timelines and additional costs.

7. Intellectual Property

  • 7.1 Website Content Ownership
    • 7.1.1 All content on the Site, including but not limited to text, graphics, logos, icons, and images, is the property of Reliant Trading CC or its licensors and is protected by copyright, trademark, and other laws.
    • 7.1.2 You may not reproduce, distribute, or create derivative works from any content on the Site without our express written permission.
  • 7.2 Client Project & Deliverable Ownership
    • 7.2.1 All preliminary concepts, drafts, mockups, strategies, source files, and working files remain the property of Reliant Trading CC unless otherwise agreed in writing.
    • 7.2.2 Ownership of final approved deliverables transfers to the Client only after full payment has been received.
    • 7.2.3 Reliant Trading CC retains ownership of:
      • 7.2.3.1 Internal processes;
      • 7.2.3.2 Frameworks;
      • 7.2.3.3 Methodologies;
      • 7.2.3.4 Unused concepts;
      • 7.2.3.5 Design systems;
      • 7.2.3.6 Development tools and reusable code libraries.
    • 7.2.4 Clients may not resell, redistribute, or modify deliverables beyond the rights granted in the applicable agreement unless authorised in writing.

8. Portfolio & Promotional Rights

  • 8.1 Reliant Trading CC reserves the right to display completed work, project excerpts, visuals, branding materials, website screenshots, and related content in:
    • 8.1.1 Portfolios;
    • 8.1.2 Case studies;
    • 8.1.3 Social media;
    • 8.1.4 Marketing materials;
    • 8.1.5 Industry submissions;
    • 8.1.6 Presentations.
  • 8.2 If a project is confidential prior to launch, the Client must notify us in writing.
  • 8.3 Any confidential business information shared by the Client will not be publicly disclosed without permission.

9. Website & Technical Services

  • 9.1 Clients are responsible for:
    • 9.1.1 Domain registration and renewal;
    • 9.1.2 Hosting services and associated fees;
    • 9.1.3 Third-party software, plugin, or subscription costs unless otherwise agreed in writing.
  • 9.2 Reliant Trading CC does not guarantee uninterrupted website availability or error-free operation due to factors outside our control, including:
    • 9.2.1 Hosting outages;
    • 9.2.2 Third-party software failures;
    • 9.2.3 Cybersecurity incidents;
    • 9.2.4 Platform updates.
  • 9.3 Ongoing maintenance, backups, updates, SEO, or technical support require a separate maintenance or support agreement unless otherwise stated.

10. Marketing Services Disclaimer

  • 10.1 Reliant Trading CC does not guarantee specific marketing results, including but not limited to:
    • 10.1.1 Sales;
    • 10.1.2 Leads;
    • 10.1.3 Engagement;
    • 10.1.4 Website traffic;
    • 10.1.5 Search engine rankings.
  • 10.2 Marketing performance may be influenced by factors outside our control, including market conditions, platform algorithms, competition, advertising budgets, and client responsiveness.
  • 10.3 Advertising spend and third-party platform fees are separate from service fees unless expressly stated otherwise.

11. Third-Party Links

11.1 Our Site may contain links to third-party websites or platforms. We are not responsible for the content, availability, policies, or practices of any third-party services.

12. Limitation of Liability

  • 12.1 Reliant Trading CC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our Site or Services.
  • 12.2 Our total liability relating to any project or Services shall not exceed the total amount paid by the Client for the applicable Services.
  • 12.3 We make no warranties or guarantees regarding uninterrupted access, profitability, business performance, or commercial outcomes of our Site or Services.

13. Indemnification

  • 13.1 You agree to indemnify and hold harmless Reliant Trading CC, its employees, contractors, affiliates, and representatives from any claims, liabilities, damages, losses, or expenses arising from:
    • 13.1.1 Your use of the Site or Services;
    • 13.1.2 Materials supplied by you;
    • 13.1.3 Your breach of these Terms;
    • 13.1.4 Any infringement claims relating to content provided by you.

14. Privacy

15. Governing Law

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site constitutes acceptance of the new Terms.
